True case of adultery

This is a true case of adultery on the part of wife.....whatever was the reason.
Husband should file for the divorce and move forward...and ethically husband should not be abide by alimony.

The feminists might be smirking in the corner hearing this anti-male "order" by the honorable court.If you are a good husband and your wife is lseeping with another man and when you scold her for her infidelity ,she will just leave for her lover's house...............Atleast the husband should be provided the dignity of a legal divorce before his wife starts living in with her lover.

Rest aside, the motion filed was habeus corpus on illegal detension not of adultery. So court has dismissed the case correctly. I he wasnts he can file case again of adultery.

There is a big problem for the lover, who now faces a charge for adultery. Here, all three parties lose. It comes across as a mindless judgement. Also, in case of divorce the wife in this case does not deserve even a single penny, because she can get what she wants from her lover. The woman should be completely excluded from all claims to the property etc.

first this case is different,
the motion filed was habeus corpus on illegal detension not of adultery. So court has dismissed the case correctly. I he wants he can file case again of adultery.
rest aside,
ethically and morally it may be wrong. But culture should be in mind and heart not to be forced. So culture should spread and ppl should belive in it. If ppl break it u cant force them to do this bcos it will result in unhappiness in the individuals and in society. The children of unhappy couple can turn into sadists.

Sorry Bala. Indian law is clear. A wife cannot be sued for adultery. She has legal sanction to commit adultery. Only the husband cannot commit it. Poor cockholders!

ya , as per the law of nature we should not be compelled to live our live just like hell, talk to many guys marraiage is not a sucessful institution but the things are moving under heavy social pressure couples are suffering from each other but could not discose to anybody.
but the real question is ,is it right that the relationship which gave us so much of support for thse many years and leave them just for teen sense of act. I WANT TO ASK DO ALL LOVE MARRIAGES ARE A SUCCESS AFTER ALL THEY ALL ARE BASED ON LIKINGS ONLY. I M SURE THE ANSWER IS HORRIBLE NO .

Irresponsible journalism/reporting

The way the judgement is presented by the reporter is absolutely misleading. The Judges have noted that the necessary ingredients which is required for passing a writ of habeas corpus is ILLEGAL DETENTION and the same is missing in this case, hence the writ of habeas corpus couldnot be issued.
The observations of the Judges are following the above finding given on the legal issue, and donot have any binding force.
The husband has other courses open to him, like approaching matrimonial court for Restitution of Conjugal Rights or going to police or court with complaint of adultery. But the court has merely held that a case for habeas corpus is not made out and hence such writ cannot be issued.
Whosoever has reported the above, has simply twisted the facts and findings recorded in the judgement to make it a sensational news, which is bad, both ethically as a journalist and morally as a citizen.

RIGHTLY SAID !!! Who is sure that this same WOMAN wouldnt have another lover tomorrow? (This can ofcourse be true for a man as well). The woman should do all this before marriage. A spouse has got no right to ditch and ruin his/her partner's life and their children's life as well. Agreed she might have had some trouble to express her opinion with the pressure from her parents. Then why didnt she seek help from the so called police/court at that time? No family would have any integrity this way. What would happen to the children of those parents who keeping changing their partners in quest for love/lust. Children of future generation would miss the love of either their dad or mom. Where are we moving to finally? This is where the CULTURE comes into picture, which ensures the family bondage, that love and affection. There is no GUARANTEE of one's heart, it keeps driving humans in all directions. One cant run in all directions at the same time. WE SHOULD BE PRACTICAL. This is all the western culture. Indians are known for their family discipline rather than country discipline. Now we anyway dont have a CONCERN or DISCIPLINE for the country and the FAMILIY DISCIPLINE will follow. So, we indians will finally become totally undisciplined people.



Unless the situation is extreme(where a spouse may not be fit for enjoying the conjugal rights) this judgement doesnt hold good.

I am surprised to see that so many people are supporting this judgement, be it the case of a man or a woman.

I think Indian law and all the people who are supporting this judgement have gone nuts.

I was talking about couples having children in general. I would be happy if the court had just dismissed the habeus corpus in illegal detention and not denied of the right of the husband to file a case of adultery. Thanks for the info. REDIFF SUCKS BADLY. GROW UP REDIFF. YOU ARENT GOING TO MAKE BIG THIS WAY.

I think we are too dependent on judiciaries and take whatever they say which is not right becasue they also may be wrong. However I also respect judiciary as a body but I think some smart people in judiciary will spoil ou whole culture by taking these types of decision which will defame our socielty as well our family as India.

here court issued judgement on the habeus corpus of detension. Husband filed the motion of illegal detension of wife. Here the question of morally right or wrong doesnot come. If he had a filed a case of adultery then it is different case. Then lover can be arrested and husband can give divorce on that grounds without alimony. But the wife eloping with the lover doesnot give to husband to file habeos corpus of kidnapping or illegal detension. Some bad lawyer helped him to file his case.

When filing a motion, think the realtion of the motion with the wrong u have suffered.
