Lagidu has a good comment here. . Anyway, while the woman's wish is important, there is another way for it - divorce. Unfortunately, with the SC making it difficult to get divorce, this kind of elopement situations will only increase. The SC should think about the effects of its ruling. Raj HC ruling is fine, given the circumstances.

Wait for few more years...and you will have judgments which say if a men does not lick the feet of his wife thrice x 2 everyday (once before meals and once after meals) he can be hanged to death at the sole discretion of wife(and not the judge). All judges will stop listening to family cases because women will the victims and also the sole arbiters who can pass any order whatsoever which can not be challenged in any court of law or justice.
This time around Delhi Govt planned additional budget for women empowerment and that budget will go exactly into framing such laws as above.
Our (male?) parliament will not think twice or hesitate of pass such ruthless laws, because they think it is good if they can eliminate other males from this society, as they then can lay hands on so many available women free of cost. It is evolutionary animal(male) instinct and desire to advance in mating queue that is making those scoundrels in parliament to pass such laws and literally waste precious tax payer money on women empowerment.

Good news !!! The communists are in power and the women are going to be nationalised soon.
Normally such a wife starts with complaints of harassment by the husband and then goes through the process of further compalaints against in-laws, physical beating, demand for MORE dowry, husband's infidelity or impotence and then culminating in getting every person in the family arrested under non-bailable warrants. Harassed husband and family will agree for a settlement out of court and pay huge money to escape further harassment. The enriched lady will go and start a new innings richer by a few more lacs.
But, this husband Sahab Singh is a lucky ba$t@rd. He has escaped a lot of harassment and financial strain. His honey has made it an open and shut case for him. Once again, lucky ba$t@rd!

There is a big problem for the lover, who now faces a charge for adultery. Here, all three parties lose. It comes across as a mindless judgement. Also, in case of divorce the wife in this case does not deserve even a single penny, because she can get what she wants from her lover. The woman should be completely excluded from all claims to the property etc.
This judgement of the High Court has opened a Pandora Box. This is indeed a very interesting decision. If a woman can live with her lover, even after her marriage, then why can't a husband do the same. But as per my knowledge, if he does the same, this becomes a case of Infidelity and his wife can sue him for Divorce. Not only this, she can ask for an Alibi too. Interesting. So, in the case if wife starts living with her lover, does the same rule apply? Can the husband ask for an Alibi from his wife (?)? Also, this will be very easy for those girls, who will marry against their wishes and where their parents want them to marry. At that time, they will marry as per the parents' wish. The very next day, they will elope with their lovers because Law allows them to do the so.
Tomorrow again, if she is not satisfied with her lover, she may come back to her Husband because she got legally married to her. Interesting...........someone has rightly said....."Variety is the Spice Of Life" :)) :)) :))
i really do not agree with the decisions of judges, whether it is question of our indian culture or others, it does not mean that after willingly marriage as settled by parents and accepted by the bride and bridegroom, such unofficial departure is not suggestable, either they should go for divorce. Tommorrow, if any husband may also bring another lady and claims he does not like to live more with his wife and he loves to live with other women without the consent of his wife, will court make decision in favour of that man? What about his family and wishes of his wife? This is matter of sreious concern to our changing society.
Why do we need to recognize marriage, family, son, father, wife, etc....if anyone can elop with anyone, there is no need for recognizing relationship! This woman later would come back claim properties by siting equality! If everything needs to be in favor of women, law can be frame in such a way men have no rights!
