Gross violation of human rights
by Hazrat Muhammad on Apr 10, 2007 11:52 PM  Permalink  | Hide replies

It is gross violation of human rights of the poor couple separating them like this from their family. They spent their life in US and had their children there. In 16 years they are naturalised citizens. Indian government should persuade the US to take them back. They have a right to live in US if they feel like it

I tend to agree. Many people just look at the rosy picture and do whatever it takes (even illegal) to get it. But then they also forget that it is the US of A and NOT INDIA...where "sab chalta hain"!!

Research by my good friend
by chirag sanghavi on Apr 10, 2007 04:06 AM  Permalink  | Hide replies

A research performed by one of my good friend says that 96% of NRI who have their babies born in USA (because they want to get citizenship or any other similar benefit) do not realize what would happen if they go back.

A child born in US has to be a US citizen by US Law. And a US Citizen can not be a dual Citizen (Dual citizenship is not supported by US).

A child can not renounce his US Citizenship on his own till he is 18.

Even if one renounces US Citizenship, when they come to India, they will still be a 2nd class NRIs (who will have less rights compared to regular indians) e.g. they will have to pay higher fees.

So all the readers, planning to have their babies in USofA, pls beware. If you are going to return to India youself or forcebly, think twice about settling in USofA or having your babies in USofA.

Wrong Info.. the son need not be an Indian Citizen to live in India. HE can get the PIO card which allows him to stay here.

US DOES have the dual citizenship option. I know many people that're dual British-American citizens.

There is a reason why they can not get their son to India
by chirag sanghavi on Apr 10, 2007 03:51 AM  Permalink  | Hide replies

There is a reason why they can not get their son to India. In India, their son's education opporunities will be highly limited (Because he will be an NRI, and he will have to go thru the Quota system set up by our great politicians).

Second thing is that US Laws will not allow their son to become Indian Citizen till he turns 18.

Their best chance is to move to any other country which allows them to move and have their son get education without getting in to quotas or any other legal issues.

Here is the link to the US Law:
http://travel.state.gov/law/citizenship/citizenship_776.html. If their son is not able to convince US Embassy, he can not get Indian Citizenship. Which means he will be a foreigner if he comes to India.

How dumb these ppl are to apply for political asylum?didnt they realise this at all?
If at all they want to be with their son, why cant they call him back?
Why do they desperately want to cling to USA?

Its obvious that if u apply for political assylum , u cannot visit that country , since the very reason u applied for assylum is cos of the percevied threat to u.
they can certainly bring the child back to india , and they have made a choice to keep him in US.
U cant have the cake and eat it too.
