The question having a child is a part of family plan exercise in which the woman should also a party. There are ample judgments in which the family decision have been delineated like working away from the family. But No authorizes the man to have involuntary sex if so the same will be great cruelty and the women concerned should secure judicial separation for making the same as offence. But all sudden the spouse can not withhold herself from family obligations
As soon as one party in the marriage does not want to remain in the marriage, the relationship is dead. No one needs to prove "Grounds" to some third party fellow called a Judge, who then decides whether my relationship with my spouse should continue against my wishes or not.
This attitude is an extension of the mai-baap sarkar mentality where the state intrudes into your personal life.
I don't like my spouse - End of discussion. The only thing left for a court to decide is:
alimony (if there is no pre-nup) child support.
This is 2007 Anno Dominingo and someone needs to tell that both to the judges and this so-called "noted" supreme court lawyer.
Remember, a judge is a Judge of Law - not morality or social mores. His/Her only qualification is that they passed the bar exam some 25 yrs ago. If I need sermons on social morality, the value of marriage etc. etc., I will find a priest.
