Traders should be Rehabilitated first and then only Government can continue their sealing. All of a sudden where all these families will go and because of this families will be pushed to below Proverty level.

Why there should be any rehabilitation? Is it natural calamity? First you commit the crime then scream for celemancy. I think we should never encourage any corruption. The traders must be thrown immediately and should be prosecuted for breaching the law otherwise these neata and traders would sell everything for few bucks.
We indians have a callous attitude for the laws of the land. The situation is no different in other cities. In fact, it is more ugly in most of the other cities than in Delhi. We basically have problems following the laws, period.
If we cannot follow laws enacted by our own representatives, whose laws are we going to follow? Where is sanity in this society. Can there be any better proof for what VS Naiupal said about Indians (that we are decaying civilization). I feel death is welcome rather than living in such an uncivilized society.
Part III May I request the Honorable Supreme Court to find out the reasons for abatement of these types of crimes and bring truth to the public. Honorable Supreme Court MUST PUNISH all responsible people who have allowed this to GO ON, otherwise people will not have full faith in our Justice System.
Since this is going to be major issue/problems for people and government, I suggest an Open House discussion which should be telecasted LIVE on major TV channels (at least for 3-4 hours) that should comprise people from following sections
- The senior officers from MCD, DDA & Police - MPs, ex-MPs, MLAs, ex-MLAs from all political parties from Delhi and Some ministers from the state and central goverments - Traders who are at risks - People from general public - Honorable Judges from High Courts/Supreme Courts - Law experts like Lawyers, Advocates
As on today talks/interviews are being aired in isolations.
This will be able to bring all kinds of views for the problem at one platform and can lead to some permanent solutions !!!!
Part II All these have been going for the last 40-50 years, where government agencies are also witnessed to this, even some politicians may have inaugurated some shops/malls etc as well. Was it not known to them. I also see, many people from the MCD and judiciaries are also buying items/services from these establishments. The law is to be implemented only when some one files a case and fight for justice in a court and all of a sudden some verdicts like this come and create a STORM in the city?
Public expect following from Honorable Supreme Court : (As people are losing faith in political and bureaucratic setup..)
- What is the duty of these departments to warn innocent people not to invest and start such things which might cause BIG loses in the future. - What advice has been given to civic authorities to prevent any unlawful activities. The implementation of such guidelines should be fool proof so that NO ONE can find a loophole and misuse the law. - Time to time notification/communication be made to people so as to ensure compliance - Any person(s)/body found violating the laws, how to take fast action to prevent it. - Finally ask govt.agencies to reply on the same.
Part I The order of sealing the commercial establishments running in residential premises by the Honorable SC Court will be complied by the Government. It is also true, every person must comply to the orders/judgments passed/delivered by honorable courts of India, which will pose a greater confidence in the judiciary. This practice MUST exist to continue for betterment of people in a democratic nation like India.
The Honorable Supreme Court has given a verdict which is punishing one side of law-violators .i.e the current owner of the commercial establishment but NOT those people who are equally rather more accountable for the crime to have happened under their jurisdiction. These suffering people have invested all their fortunes so that they can earn a livelihood for themselves and their families. After sealing, where these people will GO ?
Running commercial activities in residential premises have been defined UNLAWFUL by the honorable courts so far, does this mean people in the Delhi government, higher officials in MCD, Police, DDA and other civic bodies did not know the law, then who have recruited them and were giving salaries for the job for which they do not have the subject knowledge !!!. If it is NOT so, then why they have allowed
since last one year the traders , Govt & supremecourt has mashed the delhi. my concern iswhy the supreme court, traders & govt dont speak about the encrochment of the Roads? why the industry which has been alloted plots in industrial area and not moved in till be stand cancelled.where is the clearcut demarkation of Commercial Activities. why supreme court has not directed the govt to build official space.
Respected Sir, While respecting the verdict of the apex court the Government should come out with some tangible solution to the problem.Socialy all walks of people are involved with this situation.Why Government agencies firstly allow this menace for petty ends for years together and now do not find way to address this grave issue. Are any body paying attention to growing slums and garbage dumps in Delhi particularly in East Delhi.
While one reads about Delhi, one suspects as to when Mumbai is going to get cleaner. Here in Mumbai, squatters are there along footpaths even on the key roads of the city. Is Supreme Court only for Delhi.
Today traders are losing the source of income but what about all those Govt employees who were supposed to stop such illegal activity took bribe and let situation deteriote to such an extent. They will go scot free and resume this activity once every thing cools of. Over enthusiase shop & factory owner have neglected the societal values and took law in there own hand knowing well that they are doing some thing wrong but due to money they tried to deviate the law. Congestion in residenctial area is a big problem still shopkeeper still ignore it.Just ask them self how many park there vehical on road creat problem for other and instead of apologitic they argue that its govt road not yours. People are in Delhi are becoming so self centred & money minded that fall was inevitable. People get money throught rent,commercial activty,shop etc and use all states previalge without paying any commerial obligations.So attitude of indeference lead to this present state.

Its strange that Court has seen the one side of story that commercial activities in rsedential activities is hamparing the beauty of Delhi but what about basic needs of people.One cannot think of beauty if you do`nt have any thing to feed for your self ang family. If means of living is taken then there will be anarchy in the society. Better Govt provide them some solution.Ofcourse GoM and other Govt employees have secure job still they take bribe they have nothing to lose except bribe for some time .they should be punish 1st.All political party are showing crocodile tears only.
Since Delhi master plan formulated in 1962 and later it was always delayed due to some reason or other only Govt in the Delhi/Centre and DDA/MCD knows better,However people were not aware of the limitation of the act so they kept on doing what they thought was good.Ignorence can not be alibi.However peolpe who were supposed to execute this too were ingnorent,then there is something really fishy. Delhi did not became what its today its gradual process of change.Authourities will say who were in charge in past are retired so Suprime Court can ask the GoM to make a list of people who were in charge during this period be politician,DDA or MCD there name be published and since all were on govt payroll their where about could be traced(even if retired) and action should be taken to give astrong message to other. This may take time but not impossible.Govt employee & politican will thing twice.
