Jessica Lal's real culprits
by K. Srinivasan on Feb 22, 2006 02:59 PM  Permalink

Since this Guest column is written by a distinguished supreme court lawyer, can she do some thing to bring back the culprits to the court?

We do not need any analysis and drawback in the system which a common man can read and understand.

I request you to do something constructive, being a supreme court lawyer and people of this country will worship you.

Jessica Lal's real culprit
by RAJU RAINA on Feb 22, 2006 02:50 PM  Permalink

The real culprit for the accuital of murders is the persons who turned hostile and who dodn't even dared to come forward to report crime. They are worst than parasites of this society, i think those persons should be tried and given more severe punishment than the murder. And the second one responsible for all this is our criminal and judicial system, which still is running on rules set in 18th century. Why can't our judicial system go scientific to investigate the murder. And there should be punishment for persons who turn hostile during trial.

Police Must Investigate in Fair & Impartial Manner
by Mridula Shukla on Feb 22, 2006 02:47 PM  Permalink

I fully agree with Indira Jaisingh when she says that the police is sticking to old methods of investigation and not using modern and scientific methods for investigation. Take for instance the cases of false dowry harrassment cases (498A IPC), where more than 90% cases are false and police spend lot of time harrassing innocents and do not drop alleged accused in investigation stage only. When the case is referred to trial in the court, being a false case the court acquitt accussed - but eventually it end up wasting a lot of time of court. This kind of false 498A cases waste so much of court's time that cases with much more merit (like Jessica Lall's) end up in a trial spanning over 7 years with acquittals. It is the joint responsibility of media/police and society to highlight the misuse of such dowry cases so that court can put much more time in henious criminal cases. False cases like dowry also create an impression in judiciary's mind that more and more cases are false and resulting acquittal in other criminal cases also.

How could he accuse the witnesses?
The whole law system is corrupt and rich people always have the luxury of evading law.
The witnesses why should they pursue something heroic and loose the lives?
The only way to punish rich is strip them of all the wealth, which gives them the confidence and arrogance to take a life. Life is so precious and they are really mean people who dont realise its value. Only their conscience will become thier enemy and judge. I assure , they will never be happy.

rich and powerful
by Raj Aggarwala on Feb 22, 2006 02:45 PM  Permalink  | Hide replies

President APJ Abdul Kalam has commented many times, "Why is it that only the poor get hanged in this country?" This question somebody must answer, otherwise every rich and powerful man has the capacity to get away with murder. Thank you.

Deepak, you are missing the point: there will always be corruption in the "system". Its up to us as citizens to stand up and be counted - and there is always a price for the truth. The witnesses were absolute COWARDS, and the police investigators were worse.

By your skewed logic, there should never have been a struggle for freedom, the 'system' would be blamed. People gave their lives, and still do, for truth and justice, as thats the foundation of any decent institution/state. The high-society (dregs?) have, by their silence, connived in the murder of Jessica, and in the murder of justice. What if it was your sister who was murdered? You would sing a different tune, I am sure!

dont blame witnessess, blame the sytem
by Deepak Sood on Feb 22, 2006 02:45 PM  Permalink

why are you blaming the witnesses, calling them coward...govt should own equal responsibility of protecting the witness and increase his/her confidence in its judiciary,

govt couldnt bring justice to the whistleblowers of NHAI case yet...a person who rises to such occassions, soon finds oneself in graveyard...

are u going to protect the person lifetime from the people they get lifethreats !!

its very easy to say then done...how hollow our politicians and judicial system is...can be seen from such cases !!

Ms. Jaising,

Did shed similar chrocodile tears when witenesses turned hostile in BMW case and one of your eqully 'distinguished' colleague quoted US practice of out of court settlement for money (which Nanda's had aplenty.)
You all have set ominous precedences for your convenience.
