Death Penalty for Abu Salem
by Supritha Shetty on Nov 13, 2005 11:11 AM  Permalink

Yes, he should be sentenced with death penalty. So that these underworld dons should not make dare to break the peace of the country. The 1993 riots still have the effect on not only Mumbai but also in other parts of the country.

Death Penalty for Abu Salem
by Bhalchandra on Nov 13, 2005 11:04 AM  Permalink

If the crimes committed by Abu Salem deserve death penalty, the judge has no choice but to announce death penalty for him acccording to the Indian Law.

It may be that the Government of Portugal, from where Abu Salem has been extradited and where there is no death penalty, has made " NO DEATH PENALTY " as a precondition for extrdition. In case the Government of India as acceeded to this condition, Abu Salem can be kept in the death row cell till the end of his life.

No Death Penalty
by Raghav Narayanan on Nov 13, 2005 11:04 AM  Permalink

The Government cannot give death penalty. Whether Salem deserves death or not is a different issue. Of course he does. He is better off dead than alive.

But since an undertaking has been given, he cannot be killed, or else no further extradition will be possible from the EU.

Of course, this could imply some PILs being filed... but realistically, he cannot be killed.

India should have thought twice before demarche
by Ashish Arora on Nov 13, 2005 11:00 AM  Permalink

It's a diplomatic failure (to us) if we are extraditing a criminal accused of henious crime with pre-conditions and that too from a country who has signed extradition treaty with us. I believe India has to chew its words or take Portugal into confidence to free it from any preconditions to avail full justice. Moreover, how would a court's sanctity be maintained if it is not acting with full wisdom & its hands are tightened with these diplomatic prerequisites.

I suspect execution of death penalty
by ram manohar vikas on Nov 13, 2005 10:57 AM  Permalink

contd.

The verdict is necessary because this will create a situation when all wings of Indian democracy will begin acting in tandem. It is mess at the moment. Why did executive signed on the undertaking without consulting judiciary? The answer has two parts, first one is structural in nature in the sense that executive does not reports to judiciary and second one is systemic process. Judicial rationality would have made extradition impossible. And it is fair to assume that giving death penalty was not at the back of the mind of executive. I presume that the motive was to deconstruct the structure of the Bombay Blast and beyond that, to get to the foundation of underworld architecture. What will state of India and Indian socity will acheive by killing( read by executing death penalty) one person ? It is more important to know the processes and network of underworld crime. That will help a common man and society to feel free and consequentially get empowered. But then executive have to have honest in its approach. It should be not such that this acts as alibi for complacency which we often see emperically, hardcore criminals escape during undertrail.

Death penalty for Abu salem
by NANDA DULAL BHATTACHARYYA on Nov 13, 2005 10:50 AM  Permalink

No i do not think so, i think abu salem are outcome of our bankrupt politics and when we are thinking of globilizing our country.our focus should be more of practical approach, and we should pardon him by given him a life time imprisonment and utilizing his information to identify the black sheeps who make this Abu Salems in our society.just killing a person will not help it is the thought process we should kill, killing the thought process will automatically kill these Abu salems.First we should look in our backyard before blaming a person i beleive alone person cannot change something it his thought process which is soley responsible for all the outcome

Re: Death Penalty for Abu Salem!

When the government has managed to get Salem extradited specifically on giving Portugal the assurance that he would not be given the death penalty is it not academic to discuss this entire question? If we do not stick to our promise in this regard, there will be a diplomatic crisis and other wanted fugitives fleeing to Europe would not be extradited in future.
