The Indian Laws

For all those who are raving and ranting about Phaneesh.

Not sure about the truth of the story but would like to highlight/guide the innocent souls here about the laws in India (since we're very good at pointing fingers at others - that's the sorry state of affairs of Indian society).

Please read the Domestic Violence Act and you will realize what you (Males and their families in India) are up against.

Along with this, NCW (National Commission of Women) is proposing a bill for Sexual harrasement at workplace leaving a wide gap for misuse. In fact, all the women supported laws are being misused by unscurplous women to extort money and property from the husband. While the men orgnaizations figting for stopping the misuse, the same is being opposed by NCW since this is the only way they would let a unscrupulous woman make money and the system gets a cut out of it. With the enactment of this law (as-it-is), more and more top shots in the industry will be targets for misuse since it is an easy money making opportunity. Even if a female employee is not getting promotion due to non-performance, she can threaten her boss with a law suit and get the undeserved promotion.

It would be awesome to get this bill tabled approved as-it-is since this is the only way misuse can spread and government can wake up to the dagger which will bleed the industry.

Welcome to world of women empowerement.

One day, it could be you or your relative facing prison and such lawsuits.

That Case Apart

I heard they have Discos at offices in Indian IT companies. Is this true? I dont know of any US company that has such a thing. Not even Viacom (dont know if Viacom still owns MTV).

Ok so now we all know it -

Phaneesh Murthy fell from grace while he was at the top of the game at Infosys for sexual harrasment cases bought against him -

now MOVE ON people!!

This is the problem with our country - we cannot look past mistakes and objectively view contributions of an individual! Agreed that this man did not live up to high moral standards... but he also paid his dues by resigning and the public humiliation he and his family faced since then.

This article talks about the impact he has in a company that has been down in the dumps and has positioned it as a strong player in the space. Think of the morale he has established in his employees.. not to mention share holder value.

This is all besides his splendid achievements at Infy while he headed sales in North America.

Lets stop this obsession with a persons weakness - everyone has it. We can only hope Mr Murthy has learnt from his mistakes and we can all move on!

Some news clippings :

18 October 1999: Reka Maximovitch joins Infosys as Phaneesh Murthy’s assistant
December 2000: Reka Maximovitch quits Infosys
January-June 2001: Reka takes out two restraining orders against Phaneesh; of which she alleges at least one was violated
17 December 2001: Reka files a case against Phaneesh Murthy and Infosys for "sexual harassment and wrongful termination"
January 2002: Phaneesh warns Nilekani of the possibility of a sexual harassment case against him and the organization. Says he is innocent and the company is not at risk
23 July 2002: Phaneesh quits
25 April 2003: Case settled out of court for $3 mn, payable in a month


Announcing the settlement, Infosys chairman NR Narayana Murthy said under the terms of the agreement, Infosys "reserved the right" to take action against Phaneesh for non-participation in the settlement (not paying up any part of $3 million) and for his conduct.

According to Narayana Murthy, Phaneesh did not inform the company about his consensual relationship with Maximovitch, who was his executive assistant from October 1999 to December 2000... nor did he tell the company about two restraining orders she had obtained from the court after she left the company (See box, Timeline). Finally, he informed chief executive officer Nandan Nilekani there was a "possibility of a case being filed" a month after the case had already been filed.

Infosys sales chief quits over sexual harassment lawsuit

Phaneesh Murthy, director on the board of Infosys Technologies Ltd and the company's head (sales and marketing and communication & product services), resigned on Tuesday in the wake of a lawsuit filed against him and the company, alleging wrongful termination and sexual harassment of a female employee, who was till recently on the rolls of Infosys.

IT bellwether Infosys Technologies Ltd on May 11 said it had entered into a $ 3 million out-of- court settlement with its former employee Reka Maximovitch in connection with a sexual harassment lawsuit she had filed against the company and former Infosys director Phaneesh Murthy.

Infosys chairman and chief mentor N R Narayana Murthy told reporters that Infosys will contribute $ 1.5 million and the balance $ 1.5 million will be paid by insurance companies, under the company's directors' and officers' insurance cover.

Murthy said under the terms of the settlement, Infosys retains all rights to proceed with legal action against Phaneesh Murthy.

Good Job Mr.Murthy,all the companies have a bad practice when they wanted to terminate any of their employee or when employee wanted to quit the company.Nothing but allegations
