Amendment of Indian Patents Act
by Dr.K.M>Dhasmana on Mar 24, 2005 10:01 PM  Permalink

Under the WTO agreement, Govt of India has modified its Patent Law, where product patent applications have to be accepted and examined in India and a "mail box" provision has been introduced. One of issues that have been raised in this context is India could grant patents on formulation, new dosagees and new usages which is only desiogned to prolong the life of drugs whose patent is going to lapse in short period of time. I do hope a serious re-thinking has to be done to ignore these minor innovation in order to keep prices of medicine at affordable level in India. In addition ,India should change in its Patents Act in oder to prevent granting patents on products coming under "generic drugs". Moreover, if a newly developed drug introduced to Indian market should be availavle at affordable price which should be dependent on cost of manaufacturing of the said drug.In the long run India can be benifitted with establishing research and development centre for new drugs with clinical trials centres where they will have advantage over other contries on cost basis and availability of vast scientist to carry out the work.
